Supply Partner Communication #3: California Statewide Executive Order N-33-20
March 23, 2020

Dear Customer,

As you have likely heard or read by now, late yesterday evening California Governor Newsom issued Executive Order N- 33-20 which orders “all individuals living in the State of California to stay in their homes or at their place of residence except as needed to maintain continuity of operations of the federal critical infrastructure sectors.....”. Included in the critical infrastructure sectors are grocery stores, supermarkets, convenience stores . . . and importantly “businesses that supply other essential businesses with the support or supplies necessary to operate”.

In a link attached to the Governor’s Order is an explicit description of the kinds of companies exempt from this Order which includes “food manufacturing employees and their supplier employees”. Thus, it is very clear that Nellson employees are exempt from this Order. Furthermore, the Center for Disease Control (“CDC”) states that as part of the critical infrastructure sector we have a “special responsibility to maintain our normal work schedule”. We will do everything we can to fulfill this responsibility. We will continue to operate normally until further notice to produce and distribute products important in serving the nutritional needs of the population.

Due to the critical nature of the products Nellson provides, it is imperative that our suppliers and business partners also remain in operation while ensuring the safety of your workforce. If you are unable to remain in operation or have concerns about your ability to provide Nellson with an amount of materials commensurate with our average demand over the past six months, please contact us immediately at jack.spallone@nellsonllc.com .

We will of course continue to take all reasonable precautions to ensure the health and wellbeing of our employees and their families during this challenging time. These measures include constant reminders to adhere to strict sanitation and personal hygiene standards (Wash Your Hands!) as well as “Social Distancing” in which we prohibit large group activity in our facilities, severely restrict visitors, and maintain adequate distances from each other in offices, on the plant floor, and in high density areas such as the locker rooms and break rooms.

We stand ready to share our experience and actions with any of our partners if helpful. The health and safety of our employees, customers, supply partners, and the consumers who benefit from our products is our top priority. If we can be of any assistance, or if there are any questions, please do not hesitate to ask.

Sincerely,

Jamie Better

Chief Executive Officer
